SMS Privacy Policy

This policy describes how Miami Web AI handles mobile phone numbers and message content for the SMS receptionist line at +1 (786) 791-5046. It supplements our general Privacy Policy.

1. WHO CONTROLS THIS DATA

Nuko Nova Dynamics LLC doing business as Miami Web AI ("Miami Web AI", "we", "us") is the controller of mobile information collected through the SMS program described in our SMS Terms.

2. INFORMATION WE COLLECT

When you contact us by SMS or call our business line, we collect:

  • Your mobile phone number (provided by your carrier in the inbound SMS or call)
  • The text content of messages you send to us, and the text content of replies we send to you
  • Timestamps of when each message was sent or received
  • Carrier-provided delivery state for outbound messages (queued, sent, delivered, failed, undelivered)

We do not collect device identifiers, location data, or financial information through the SMS program.

3. HOW WE USE THIS INFORMATION

We use mobile information collected through the SMS program to:

  • Reply to your inbound message or scheduled follow-up
  • Maintain a short transcript of the conversation so the operator has context to respond accurately
  • Honor opt-out (STOP / UNSUBSCRIBE) and opt-in (START) requests as required by the CTIA Short Code Monitoring Handbook and TCPA
  • Provide internal audit logs that document compliance with applicable messaging regulations

4. AI-ASSISTED DRAFTING

We use an AI service to draft proposed replies for operator review. The text of your inbound message is sent to the AI service over an encrypted connection and is processed under a zero-data-retention agreement — the AI provider does not store or train on your message content. Drafts are reviewed by a human operator before being sent.

Messages classified as one-time verification codes (2FA) are never persisted in any database we operate; the raw code lives only in the operator's email inbox and the carrier's webhook payload, both of which are out of our long-term control.

5. NO SHARING FOR MARKETING

Mobile information that you provide to Miami Web AI through the SMS program will not be shared with third parties or affiliates for marketing or promotional purposes.

We do share mobile information with vetted service providers we use to operate the program — specifically: our SMS carrier (Twilio), our email provider (Resend), our AI provider (Anthropic) under a zero-data-retention agreement, and our backend infrastructure provider (Vercel and Convex). These providers are bound by contract to use the data only to deliver their services to us, and not for their own marketing or to resell.

We do not sell mobile information. We do not use mobile information for advertising or cross-context behavioral targeting.

6. RETENTION

Active conversation transcripts are retained for as long as the conversation is active and for 24 hours after the last message before the thread is closed in our system. Once closed, the transcript remains in our administrative archive for audit purposes only and is not used for further outreach.

Carrier-level message-deduplication records are retained for up to 30 days for the sole purpose of preventing duplicate processing of carrier webhook retries.

Opt-out records (numbers that have replied STOP) are retained indefinitely so we do not message you again.

7. YOUR RIGHTS

Depending on your jurisdiction, you may have the right to access, correct, delete, or restrict processing of the personal information we hold about you. To exercise any of these rights, email hello@miamiweb.ai.

You can opt out of the SMS program at any time by replying STOP to any message we send you. Opting out does not delete the historical transcript from our internal audit archive but guarantees no further messages will be sent.

8. CHILDREN

The SMS program is intended for adults conducting business with Miami Web AI. We do not knowingly collect mobile information from anyone under 18.
